INFORMATION ON THE PROCESSING OF PERSONAL DATA pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR)

Premise
The data controller of your personal data, pursuant to the GDPR, is Marbec S.R.L., with registered office in Via Croce Rossa, 5/I – 51037 Montale (PT), with VAT number no. 01455470474 (Marbec), owner of the https://www.marbec-homecare.com/ Purchases on the Site
Subject to your provision, your personal data will be processed to allow you to make purchases on the Site.
Marketing
Subject to your consent, Marbec may process the personal data you provide in order to send you advertising material and/or newsletters relating to the entire range of Marbec brand products.
Profiling
Subject to your consent, Marbec may process your personal data for profiling purposes, i.e. for the analysis of your consumption choices through the disclosure of the type and frequency of purchases you make, in order to send you advertising material and/or newsletters relating to the entire range of Marbec brand products of your specific interest.
Soft spamming
Marbec may use, for the purpose of direct sales of products, the e-mail coordinates provided by you in the context of a purchase, even without your consent, provided that it is a product similar to the one subject to the previous sale (so-called soft spamming). You may however refuse this processing at any time by notifying Marbec of your objection.
In compliance with the GDPR, we hereby inform you that Marbec will process your personal data under the following conditions.
Art. 1. Purpose and legal basis of the processing. Mandatory or optional provision. Consequences of refusal to treatment.
The processing of personal data is aimed at achieving the following purposes:
- The information and data requested in the event of registration on the Site will be used to allow you access to the reserved area of the Site and to allow you to use the online services provided by Marbec to registered users. The legal basis for the processing is Marbec’s need to carry out pre-contractual and contractual measures adopted at the request of the data subject. The provision of data is optional. However, your refusal to provide the data will make it impossible to register on the Site. Access to the product purchase services on the Marbec website is not subject to prior user registration. The latter will therefore be able to regularly complete the purchase even without the creation of an account, by filling in the data requested in the Checkout procedure as a “guest”;
- in the case of the stipulation of a contract relating to the purchase of the products offered by the Site, to allow the conclusion of the purchase contract and the correct execution of the transactions related to the same (and, if necessary according to the sector regulations, to fulfill tax obligations). This processing of personal data also includes the possibility of sending communications (e.g.: tracking and order information) through automated tools such as email and/or WhatsApp. The legal basis for the processing is Marbec’s obligation to perform the contract with the data subject or to comply with legal obligations. The provision of data is optional. However, your refusal to provide the data will make it impossible to make purchases on the Site. Marbec may send you emails to remind you to complete a purchase. The legal basis for this processing is Marbec’s legitimate interest in sending this type of communication equivalent to the interest of the data subject in receiving communications relating to an uncompleted order;
- Marbec may process your data for the purposes of so-called “soft-spam”, governed by art. 130 of Legislative Decree no. 196/2003 (Privacy Code). This means that limited to the e-mail addresses provided by you in the context of a purchase, to allow Marbec to offer similar products directly, unless you object to such processing in the manner provided for in this policy. The legal basis for the processing is Marbec’s legitimate interest in sending this type of communication. This legitimate interest can be considered equivalent to the interest of the data subject in receiving “soft-spam” communications;
- subject to your consent, for the sending of newsletters and the sending of advertising material relating to the entire range of Marbec brand products, through automated tools such as email and Whatsapp messages (marketing purposes). The legal basis for the processing is the consent of the data subject. Consent to the processing of your data for marketing purposes is purely optional. Failure to consent to the processing of data for marketing purposes will make it impossible for you to receive advertising material relating to the entire range of Marbec brand products, as well as to send you newsletters;
- subject to your consent, for the processing of your commercial profile, through the detection and processing of your choices and purchasing habits, in order both to monitor the degree of customer satisfaction and to send you advertising material, relating to the entire range of Marbec brand products, of your specific interest, through automated tools such as email and Whatsapp messages (profiling purposes). The legal basis for the processing is the consent of the data subject. Consent to the processing of your data for profiling purposes is purely optional. Failure to consent to the processing of your personal data for profiling purposes will make it impossible for Marbec to process your commercial profile, by detecting your choices and purchasing habits, as well as to send you advertising material, relating to the entire range of Marbec brand products, of specific interest to you;
- to respond by email or telephone to your requests. The provision of data is optional, but your refusal will make it impossible for Marbec to respond to your requests. The legal basis for the processing is Marbec’s legitimate interest in responding to your requests. This legitimate interest is equivalent to your interest in receiving a response to communications sent to Marbec.
Without prejudice to the above, it is understood that Marbec may in any case use your personal data for the sole purpose of correctly fulfilling the obligations provided for by the laws in force and the obligations deriving from the contractual relationships in place between you and Marbec.
We remind you that you may also object to the processing of your personal data through the appropriate link at the bottom of any promotional email sent by Marbec.
Special or judicial data
Marbec does not process special or judicial data.
Art. 2. Processing methods
The processing of your personal data will mainly be carried out with the aid of electronic or automated means, according to the methods and tools suitable for guaranteeing their security and confidentiality in accordance with the GDPR.
The information acquired and the methods of processing will be relevant and not excessive with respect to the type of services rendered. Data will also be managed and protected in environments where access is under constant control.
Art. 3. Communication and dissemination of data
Your data may be communicated:
- to all those subjects (including Public Authorities) who have access to personal data by virtue of regulatory or administrative measures;
- to banking institutions and companies that manage the national or international payment circuits through which online payments are made for products purchased through the Site;
- to post offices, couriers or shippers in charge of delivering products purchased through the Site;
- to companies, consultants or professionals who may be in charge of the installation, maintenance, updating and, in general, the management of Marbec’s hardware and software or which the latter uses for the provision of its services;
- to external companies in charge of sending advertising communications on behalf of Marbec;
- to Marbec’s employees and/or collaborators;
- to all those public and/or private entities, natural and/or legal persons (legal, administrative and tax consultancy firms, Judicial Offices, Chambers of Commerce, Chambers and Labour Offices, etc.), if the communication is necessary or functional to the correct fulfilment of the obligations deriving from the law.
The subjects to whom Marbec transmits your data may be data processors who are designated by Marbec through a specific contract or persons in charge of the processing of personal data under the direct authority of Marbec, in the case of third parties used by the Data Processor, sub-processors, pursuant to art. 28.4 of the GDPR.
The data concerning you will not be disseminated, except in anonymous and aggregate form, for statistical or research purposes.

Art. 5. Retention of personal data
Personal data will be stored according to the following logics:
- by making a request to Marbec it is possible to cancel the user’s account on the Site;
- for the purpose of executing the sales contract, for 10 years from the date of receipt of the purchase order;
- as provided for by Article 2220 of the Civil Code, invoices, as well as all accounting records in general, are kept for a minimum period of ten years from the date of registration, so that they can be presented in the event of an audit;
- for marketing and profiling purposes, until you withdraw your consent. Any personal data you provide for marketing and profiling purposes will be kept for two years from the last opening of the communication sent for these purposes, of which there is evidence, unless you previously revoke your consent. At the end of the above-mentioned retention period, Marbec may contact you to ask if you wish to continue to receive marketing communications from Marbec. In the absence of a positive and explicit response from you, the personal data concerning you will be deleted or archived in accordance with the regulations in force;
- to respond to complaints, reports or disputes, the data will be stored until the conclusion of the complaint management and, in any case, no longer than 3 months from the last communication received from the user, except for the need for defense in court;
- to fulfil the obligations provided for by the applicable legislation, the data will be stored for the time strictly necessary for these obligations;
- for the purpose of performing any service requested, for the time necessary to execute the request;
- for the purpose of defence in court, for the time necessary to defend their rights and, in any case, until the judgment becomes final.
Art. 6. Transfer of personal data to third countries
Marbec is based within the European Union. Therefore, the processing of your data is secure from a regulatory point of view as it is governed by the GDPR.
If the transfer of your personal data takes place in a non-EU country and for which the European Commission has expressed an adequacy judgment, the transfer is in any case considered secure from a regulatory point of view. To allow the correct functionality of the Site, your personal data may be transferred to the USA. Your personal data may be transferred to the USA as determined by the European Commission’s adequacy decision. With this decision, the European Commission has decided that the USA offers protection of personal data similar to that offered by the European Union.
Your data may also be transferred to non-EU countries for which the European Commission has not expressed an adequacy judgment. This article indicates from time to time the countries to which your personal data may be transferred and where the European Commission has not expressed an adequacy judgment.
We therefore invite you to access this article regularly to check whether the transfer of your personal data takes place in third countries.
Art. 7. Rights of the data subject
Pursuant to art. 13 of the GDPR, Marbec informs you that you have the right to:
- ask Marbec for access to your personal data and the rectification or erasure of the same or the limitation of the processing concerning you or to object to their processing, as well as the right to data portability
- the user has the right to request, at any time, the cancellation of his/her account registered on the Marbec website, by sending a specific request to Marbec through the contact channels made available on the website
- withdraw consent at any time without prejudice to the lawfulness of the processing based on the consent given before the withdrawal
- lodge a complaint with a supervisory authority (e.g.: the Guarantor for the protection of personal data).
The above rights may be exercised by sending an informal request to Marbec at the contacts indicated above.
Art. 8. Changes
Marbec reserves the right to make changes to this policy at any time, giving appropriate publicity to users of the Site and guaranteeing in any case an adequate and similar protection of personal data. In order to view any changes, you are invited to consult this policy regularly.
